Terms of Service
This English translation is provided for reference only. In case of any discrepancy, the Japanese version shall prevail.
Article 1 (General)
These Terms of Service (the "Terms") set forth the conditions for use of "Blue," the web application deployment and publishing platform (the "Service") provided by Sola K.K. (the "Company").
By using the Service, you agree to be bound by these Terms.
Article 2 (Definitions)
- "User" means an individual or entity who registers for and uses the Service.
- "App" means a web application and its associated files that a User deploys and publishes on the Service.
- "Content" means all information, including files, data, text, and images, uploaded to the Service by a User.
Article 3 (Accounts)
- Users shall register an account by providing accurate and up-to-date information.
- Users are solely responsible for managing their account credentials, including passwords and API keys.
- Users shall not allow third parties to use, lend, transfer, or sell their accounts.
- The Company shall not be liable for any damage arising from unauthorized use of an account.
Article 4 (Prohibited Activities)
Users shall not engage in any of the following when using the Service:
- Distribution of content that violates laws or public order and morals
- Distribution of adult (sexually explicit) content
- Use of resources for cryptocurrency mining
- Distribution of malware, viruses, spyware, or other harmful programs
- Sending spam or engaging in other nuisance activities
- Unauthorized access to others or use of the Service as a stepping stone for such access
- Interference with the operation of the Service
- Reverse engineering, decompiling, or disassembling the Service
- Interference with other Users' use of the Service
- Any other activities the Company deems inappropriate
Article 5 (Content Handling)
- Intellectual property rights in Content uploaded by Users remain with the User or the relevant third-party rights holder.
- The Company uses User Content only to the extent necessary to provide the Service.
- The Company does not provide, sell, or share User Content with third parties.
- If the Company discovers Content that violates these Terms, it may suspend Apps, delete Content, or suspend or delete accounts without prior notice.
Article 6 (Fees and Payment)
- Fees for the Service are as specified for each plan. Fee details are listed on the Pricing page.
- The Company will notify Users at least 30 days in advance of any fee changes.
- Fees for paid plans are payable in accordance with the terms of the applicable payment service.
- Due to the nature of digital services, refunds after purchase are generally not available. However, if the Service becomes unavailable due to causes attributable to the Company, we will refund fees or extend the service period for the duration of the outage.
Article 7 (Service Suspension and Changes)
- The Company may suspend all or part of the Service in the following cases:
- System maintenance, inspection, or updates
- Force majeure events such as earthquakes, fires, or power outages
- Other cases the Company deems necessary
- The Company will provide advance notice within a reasonable period when changing the content of or terminating the Service.
Article 8 (Disclaimer)
- The Company shall not be liable for any damage arising from use of the Service, except in cases of intentional misconduct or gross negligence by the Company.
- The Company does not guarantee against loss or corruption of User Content. Users are responsible for maintaining their own backups.
- The Company makes no warranties regarding the completeness, accuracy, reliability, usefulness, or fitness for a particular purpose of the Service.
- The Company shall not be liable for any disputes arising from Apps published through the Service by Users.
Article 9 (Withdrawal and Data Deletion)
- Users may withdraw their account at any time through the prescribed procedure.
- After withdrawal, User App data will be deleted within 30 days. Data restoration requests may be accommodated during this period only.
- Information required to be retained by law will be kept for the prescribed period before deletion.
Article 10 (Amendments)
- The Company may amend these Terms as necessary.
- Amendments will be notified by posting on the Service.
- Amended Terms take effect upon posting. Continued use of the Service after amendment constitutes acceptance of the amended Terms.
Article 11 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- The Tokyo District Court shall have exclusive agreed jurisdiction of first instance over any disputes arising in connection with these Terms.
